What exactly is a Homeowners Association?

HOAs are non-profit mutual benefit corporations. When planning subdivisions, planned communities, or condominiums, real estate developers form Homeowners and Condominium Associations. Anyone purchasing in a planned-unit community will receive a copy of the HOA’s covenants, conditions, and restrictions (CC&R). Before the actual closing, the title purchaser receives a copy. It is 100% incumbent on a buyer of a home in an HOA to read and comprehend this mandatory HOA agreement.

In court, there is a presumption that a homeowner has read, understood, and is bound by the rules and regulations in the CC&R. When a person buys a home in an HOA, they automatically become a member. Members elect their board of directors, who manage the homeowners association as volunteers.
